How long do I have to file a personal injury claim in Florida?
The "Statute of Limitations" sets the time frame in this state for the pursuit of a claim for damages. For automobile accidents in Florida, a Plaintiff has four years from the date of the accident to file suit against the Defendant. There are exceptions for uninsured or underinsured motorist benefits against your own insurance company in which case the Statute of Limitations is five years.
